Are Church leaders now ready to back attempts to oust the Arroyo government?

In its strongest position yet indicating that they are ready to give their blessings for what may be a drastic change in government, five bishops, led by Catholic Bishops’ Conference of the Philippines (CBCP) president Angel Lagdameo, condemned the unabated “top to bottom” corruption in government and asked the public to shake the status quo.

Lagdameo went as far as assuring the public that “liberators” may be just around the corner.

“In response to the global economic crisis and the pitiful state of our country, the time to rebuild our country economically, socially, politically, is now. The time to start radical reforms is now. The time for moral regeneration is now. The time to conquer complacency, cynicism and apathy to prove that we have matured from our political statements is now. The time to prepare a new government is now,” Lagdameo said in a forum organized by the CBCP.

Lagdameo added the public should not lose hope that changing the present system is futile. “In spite of the seemingly hopeless and negative prognosis, our liberation may yet serendipitously happen. We are dreaming, praying and hoping that our county may yet have the needed liberators.”

It is hoped that these “liberators,” Lagdameo said, “will in a courageous peaceful way effectively and uncompromisingly reform our country.”

Also present in the forum were Lingayen Archbishop Oscar Cruz, Bataan Bishop Socrates Villegas, Masbate Bishop Joel Baylon and Bishop Emeritus Jose Sorra. We learned that seven more bishops would have attended the forum but cancelled for some reasons.

Active involvement

Villegas urged the public “not to be passive” but engage “in active involvement” in effecting a change in governance. He noted that curbing corruption by only half of its present level would immensely benefit the country. “The problem is not population, the problem is rampant corruption,” Villegas said.

He said that the country would have been better prepared to deal with the ongoing global financial crisis if not for corruption.

Cruz said the country is now in a “precarious, dangerous and critical situation” because of massive corruption and directly blamed the “incumbent occupant” in Malacanang as the culprit.

In his statement, Lagdameo took to task the government’s claim that prosperity is now being felt by the masses pointing out that 20 million people will surely disagree with this, as shown by surveys. He said rampant poverty and hunger are directly related with rampant graft and corruption “which has invaded all public and private institutions.”

Endemic corruption

Lagdameo noted that corruption under the past few years of the Arroyo government up to present has become “endemic and systemic.”

He pointed to “overprized projects, multi-billion scams of various kinds, election manipulations, anomalous transactions, bribery of both high and low, unsolved murders of media practitioners” as the “faces and symptoms of corruption.”

He lamented that the country is now tagged as one of the most corrupt country in Asia, based on a survey conducted by Transparency International. “If we are not horrified, disgusted, exasperated and enraged by these realities, can we still we love our country?” Lagdameo said.

The bishops’ statements came on the heels of the arrival of former agriculture undersecretary Jocelyn “Joc-joc” Bolante from the US following futile efforts of seeking asylum there. Bolante, tagged as the main architect of the P728-million fertilizer scam, had claimed political persecution but US immigration junked his alibi.

Also providing backdrop was the current “euro” scandal in the Philippine National Police where four police officers, including one retired, are set to be charged with unauthorized release of intelligence funds, and the fresh impeachment initiatives against the President.

Church leaders have been criticized for just waiting in the sidelines and giving mixed signals on its verdict on the Arroyo administration. At the height of the wiretap scandal, where the President was caught on tape giving orders to disgraced poll commissioner Virgilio Garcillano during the canvassing of the results in the presidential elections, the CBCP sought for truth but withheld passing a guilty verdict. Lack of active Church support has been cited as one of the major dampeners on attempts to oust Arroyo.

The bishops are leading to the right tract because corruption has jumped as the Arroyo administration winds to a close. Kickbacks have also increased tremendously. The explanation is simple: Knowing that they would be out of jobs when GMA is no longer President, top government officials are providing for their future. Knowing that this or that character got so much in kickbacks, succeeding commissioners demand bigger and bigger kickbacks. It was a case of one-upmanship and immoderate greed. GMA officials’ motto seems to be: “Take as much as you can while the getting is good. Time is running out on us.”

Your observation is valid. It is very unfortunate that the very people who are supposed to manage our economy to bring prosperity to the Filipinos are the very same politicians and bureaucrats who have bled our treasury dry.

Now that Joc Joc Bolante is back, we are hoping that our farmers will be given justice. I agree with the CBCP, that the main cause of our poverty is the high level of corruption mismanagement, and highly politicized government, not entirely its growing population.

It is disappointing to note that PGMA, a U.S. educated economist, have failed miserably in her mission to improve the lives of the Filipinos. She has been swallowed up by the formidable forces of wheelers and dealers, who called themselves, Presidential Advisers, whose only objective is to make the most of what money they can make. Hence, PGMA only have as much information as the people around her wanted her to know. Her debt of gratitude to the military has limited her desire to introduce major changes.

Pity.

Corruption, I believe, is the no. 1 big reason for poverty and not population. The poorer a country is the larger the corruption is. If you go outside the western countries you will rapidly notice the completely different conditions of life. You will notice a huge discrepancy between the social layers of people. Go to Moscow, where $5 cars go on the streets next to $200,000 Lamborghinis(and of course, other cities/countries as well).

Now, why is that? Because governments and politicians don’t consider their people as shareholders to a common goal - prosperity, good salaries, affordable prices, etc. They still consider them serfs whom they own. The concrete example of this is the Espina Dynasty.
That is why some western countries have raised economically and socially in the last 100 years more than they did before. Because they realized that people are the most important resource a country can have and started treating people as shareholders. I just remembered an example of a small country that is doing extraordinary well - Luxembourg - has a population of just half a million people and is the country with the highest GDP per capita in the world. No oil, no gold, no natural resources just smart people “moving bits”.
I can tell stories how a few corrupted people changed the laws of a country in order to benefit their companies or how contracts of billions of dollars were not auctioned but bought with bribery, etc. However, that’s too long of a story and I want to reiterate and say that corruption is one of the greatest reasons for poverty. There is no permanent solution to this but through awareness the history can be prevented from happening again.

Sandiganbayan convicts ex-ARMM governor

Anti-graft court says the cover-up of some P27M in disbursements made in 1993 constituted malversation

THE Office of the Ombudsman notched a victory on Wednesday at the Sandiganbayan after the anti-graft court convicted for charges of malversation of public funds the former governor of the Autonomous Region in Muslim Mindanao (ARMM) who was sentenced for a total jail term of 162 years.

In the 51-page Decision of the Sandiganbayan First Division, written by Associate Justice Rodolfo Pon–ferrada, the court found guilty beyond reasonable doubt Zacaria Candao, former Regional Governor of the ARMM for nine counts of malversation of public funds under Art. 217 (4) of the Revised Penal Code (RPC).

Aside from Ponferrada, Presiding Justice Diosdado Peralta and Alexander Gesmundo concurred in the said ruling.

Two other former ARMM officials were also convicted namely Abbas Candao, executive secretary, for 43 counts; and Israel Haron, cashier II, for 52 counts for charges of malversation which involves more than P21 million worth of public funds.

The Anti-Graft court sentenced the three accused to a minimum of 10 years and one day to 18 years, eight months and one day of imprisonment for each count of malversation, subject to the three-fold rule under Art. 70 of the RPC.

They were also ordered to pay a fine ranging from P400,000 to P500,000 for each count and were meted the accessory penalty of perpetual special disqualification from public office.

The Sandiganbayan ruled that conspiracy was established against the accused for covering-up the said disbursements of funds which amounted to malversation.

As their liability, the Court ruled that by their collective acts in signing the subject 52 checks with Haron, through which the latter was able to consummate the illegal withdrawals, it is deemed that they “conspired to effect the illegal withdrawals of funds” subject of the criminal case.

In the antecedents of the case, the complaint was filed by the Commission on Audit (COA) after having conducted an audit on the disbursements made in ORG-ARMM from December 1992 to March 1993.

The Office of the Ombudsman presented the COA reports showing that a total amount of P21,045,570.64 have been illegally withdrawn from the accounts of the ORG-ARMM thru the issuance of 52 Philippine National Bank (PNB) checks.

Forty-three of the said checks, which were all drawn payable to the order of Haron without the required disbursing vouchers, were countersigned by Abbas Candao, while nine bore the signature of Zacaria Candao as countersigning official.

The COA sent a letter of demand to Haron dated October 5, 1993 requiring him to produce or restitute within 72 hours the lost amount and to explain the illegal withdrawals, which he failed to do. It was only on October 23, 1993 or long after the expiration of the 72-hour deadline that he submitted the supposed copies of the disbursement vouchers covering the withdrawals.

The Sandiganbayan stressed that Haron’s failure to comply with COA’s demand to produce or restitute the lost amount within the required 72 hours created the presumption that he “appropriated for his personal use the funds covered by the said withdrawals without the required disbursement vouchers and supporting documents.”

It opined that vouchers subsequently submitted by Haron show that most of the checks were issued for the peace and order campaign of the ORG-ARMM, he and his co-accused presented no proof that the said cash advances were spent for public purposes.

The Court also took notice of the fact that the said disbursement vouchers were “not accomplished by management of the ORG-ARMM in accordance with existing COA circulars on the matter because they were unnumbered and undated.”

I believed that there is a time of everything. We have to be patient because time will come that these corrupt politicians like the Espinas will be put to jail.

The case of Zacaria Candao, former Regional Governor of the ARMM, posted by Aquarius was made in 1993. So it takes so much time to convict corrupt politicians. We should remember that the Espinas are still in power and they have a lot of connections to defer any kind of court proceedings against them. What we need right now is to be always vigilant in order to monitor their illegal activities. What ever you heard about their plans and moves don’t hesitate to post it here or in Bl.com. Maybe, by doing this, it will prevent them or at least this might help to minimize their corrupt practices.

MANILA, Philippines - The statement issued by five Catholic bishops last week indicting the Arroyo administration for gross corruption and calling for its replacement has given Raul Gonzalez, the most partisan justice secretary in generations, another excuse to play his favorite game: issuing threats against administration critics.

“Strictly speaking, those [statements] are seditious,” Gonzalez rumbled. Actually, they aren’t—unless of course Gonzalez thinks we are back to the Spanish era and every unflattering remark, every act of criticism, can be easily defined as seditious.

Like Rizal, the bishops, led by Archbishop of Jaro-Iloilo Angel Lagdameo, the current president of the Catholic Bishops’ Conference of the Philippines, described a terrible cancer eating away at the body politic. “In the past few years up to today, we have watched how corruption has become endemic, massive, systemic and rampant in our politics. Corruption is a social and moral cancer.”

And like Rizal, Lagdameo and the other bishops argue that the time for action is at hand. “In response to the global economic crisis and the pitiful state of our country, the time to rebuild our country economically, socially,

politically is now. The time to start radical reforms is now. The time for moral regeneration is now. The time to conquer complacency, cynicism and apathy and to prove that we have matured from our political disappointments is now.”

And then, most controversially: “The time to prepare a new government is now.”

The bishops’ statement is both emphatic and cautious; it is clear about the ills it attacks, but it uses the right language in attacking them. Thus, contrary to Gonzalez’s blithe attempt at intimidation, there is nothing seditious about the bishops’ appeal to the people to “prepare a new government.” Calling on the people to exercise their sovereign prerogative and prepare a new government is an exercise of political maturity.

And in fact Lagdameo and the other bishops—Lingayen-Dagupan Archbishop Oscar Cruz, Masbate Bishop Joel Baylon, Balanga Bishop Socrates Villegas and Legazpi Bishop Emeritus Jose Sorra—were clear about the context of preparation: They were talking about the 2010 elections. In an interview with Radio Veritas, the Church-run network, Lagdameo explained it thus: “Since we expect to have elections in 2010, we should prepare our people for a new government, all the elements involved, including the candidates.”

But—here’s the crux—even if the five bishops called for a new government to take over today, right this minute, they would have been right to do so too. And it wouldn’t have been seditious either.

The main argument against the bishops’ appeal is that it is woefully untimely. Why now, some allies ask? Is it because the returned fugitive Joc-Joc Bolante may be convinced to talk about the fertilizer scam? Why now, other allies ask? This will distract the country from the necessary focus on the coming global economic slowdown.

There may be something to all this, but we must also ask: When is the right time to take a corrupt administration to task?

When is the right time to warn the public, in clear, unmistakable terms, about a cancer consuming the polity?

When is the right time to remind a preening government that, to many millions of its citizens, its “ramdam ang kaunlaran” [progress is being felt] slogan is an insult, a slap in the face?

When is the right time to tell an administration living in an alternate reality of its own making that it has lost touch with most Filipinos, those who live in the real world?

When is the right time to begin preparing for a new government, one that reflects the true will of the people, one that mirrors the people’s disgust with “endemic, massive, systemic and rampant” corruption? If we have to ask the very officials benefiting from the corruption, we will receive the same answer time after time: Never. It is never the right time.

Lagdameo and the other bishops have therefore done all Filipinos a signal service. They have gotten us asking questions again. Not about the way things are; we all know the true depths of corruption, because we are sinking in them. But about the alternative: a future we must begin preparing for.

Relative to this, Biliranons have not been kept up to date with what is happening with the case filed by Mr Charlie Chong against Governor Rogelio Espina at the Office of the Ombudsman.

In a previous broadcast of Gerry Espina Sr at RN, he confirmed that Governor Espina obtained a clearance from the Office of the Ombudsman back in May 2008. Therefore, it follows that the case has not progressed.

Previous broadcasts also made by "Bidlisiw" at RN mentioned in passing, that the files at the Ombudsman are missing. You can draw your own conclusions.

It is difficult for Mr Chong to push for the case as he will be accused of politicking. The case must be taken over by a non-partisan entity which has a clout to push for immediate action. Rep Glenn Chong is placed in an awkward situation as he has taken the cudgels for the Biliranons in the pursuit of this case. I admire the audacity of Mr. Charlie Chong in pursuing the action even though it has threatened his own personal and his family’s security.

Concerned Biliranons must assist and support any non-partisan entity willing to push for the immediate resolution of the case. Cases filed at the Office of the Ombudsman will be relegated to the archives if no one follows up with diligence and determination. Cases should not take over ten years to be resolved.

We have discussed about the formation of CAC in Biliran. It will be happening, just a few delays as individuals instrumental in forming the body are still currently not available.

It will happen, I promise you that.

Ex-Zambales mayor, treasurer get 10 years

The Sandiganbayan First Division has convicted the former mayor of Castillejos, Zambales and his municipal treasurer for awarding a local infrastructure project to a private contractor without holding the required public bidding 11 years ago.

Associate Justice Alexander Gesmundo penned the 20-page decision which meted ex-mayor Teofilo G. Pantaleon Jr. and ex-treasurer Jaime F. Vallejos six to 10 years imprisonment and lifetime disqualification from holding public office.

Associate Justice Rodolfo A. Ponferrada and Presiding Justice Diosdado M. Perlalta, division chairman, concurred.

The graft court junked the defendants’ claim that the project – construction of a children’s park - did not require a public bidding.

The defendants said the contractor, John B. Construction and Supply Company, was already awarded the initial phase of building the Castillejos municipal park, after being chosen as the sub-contractor by the winning bidder.

However, the anti-graft court said the requirement of public bidding is not an “idle ceremony”.

“The act of the accused in awarding to JBCSC the Castillejos contract is also in violation of the rules and regulation in the Government Accounting and Auditing Manual,” the Sandiganbayan said.

The court said contrary to the claim of the defense, the second project was separate and distinct from the initial one, which was the construction of a municipal park.

The initial project was handled by handled by the Department of Public Works and Highways.

The two have previously been convicted of three counts of malversation also for anomalous handling of public works contracts for which they were sentenced a combined 120 years.

With all due respect to the Office of the Ombudsman, their track record is abysmal.

From the beginning, I have advocated the use of high profile lawyers whom the media follows wherever they go. Putting the case in the national media and pounded regularly will create pressure on the Ombudsman to act swiftly.

I believe it wouldn't be too difficult to bring the Espina Dynasty to justice, as a mere lifestyle check will reveal a lot of violations which are enough to find probable cause.

At this stage, we will leave it to the capable hands of Rep Glenn Chong’s legal panel.

If and when former agriculture undersecretary Jocelyn “Joc-joc” Bolante, suspected architect of the P728-million fertilizer scam in the 2004 presidential election, finally appears before a Senate investigating committee, we urge him to keep in mind the Four-Way Test, the code of ethics adopted by the Rotary Club in 1943. Bolante, like President Gloria Macapagal-Arroyo’s husband, Mike Arroyo, is a member of the Rotary Club.

The Four-Way Test states: “Of the things we think, say or do … (1) Is it the Truth? (2) Is it Fair to all concerned? (3) Will it build Goodwill and Better Friendships? (4) Will it be Beneficial to all concerned?”

The test was written by Chicago Rotarian Herbert J. Taylor in 1932 and adopted by Rotary International 11 years later. He wrote the test primarily for his bankrupt Club Aluminium Co. in 1932. He gave up his job in another company to join 250 other employees aboard the so-called “sinking ship.” Taylor said: “To win our way out of this situation I reasoned we must be morally and ethically strong. I knew that in right there was might. I felt that if we could get our employees to think right they would do right. We needed some sort of ethical yardstick that everybody in the company could memorize and apply to what we thought and did in our relations to others.” And so he wrote the 24-word test.

When a company advertisement was referred to Taylor declaring their aluminum product “the greatest cooking ware in the world,” he said, “We can’t prove that.” The ad was rewritten to simply state the facts.

Bolante will soon be facing a Senate investigating committee, unless the administration can devise other delaying tactics or come up with a strategy that would permanently prevent him from testifying. He being a member of the Rotary Club, we expect him to apply the Four-Way Test to his testimony.

Is it the Truth? What is the truth about the P728-million fertilizer scam? Is it true that the President authorized the release of P728 million shortly before the May 2004 election to “favored” congressmen, governors and mayors to buy farm inputs like fertilizer and pesticides? Is it true that 53 governors were allotted P5 million each, 105 congressmen P3-P5 million each, and 23 city and town mayors P2-P5 million each? Bolante should tell the truth, because, as the saying goes, the truth will set him free.

Is it Fair to all concerned? The disclosure of the truth about the P728-million fertilizer scam will be fair to all concerned, and most especially to the people, the taxpayers, whose money was used to carry out the project. They have the right to know whether their tax money was really used to benefit the agricultural sector or a certain candidate in the 2004 presidential election. The disclosure of the truth will be fair to Bolante himself because finally, he will be able to unburden himself of some secrets, if secrets they really are, that are causing him so much mental and psychological torment. It will be fair to the Senate, which can finally write finis to this case which is actually still hanging because it has not heard his testimony.

Will it build Goodwill and Better Friendships? The truth may not always be pleasant, sometimes it may hurt some people, but ultimately it will promote goodwill and better friendships. People in government have to make truthfulness and trust the basis of their relationship with the people. Goodwill and better friendship can never be built based on dishonesty and falsehood.

Will it be Beneficial to all concerned? Yes, it will be beneficial because we should now be able to put a closure to a case that has festered like a sore these past four years. It will not be beneficial to those who committed irregularities and whose crimes will be exposed in the Senate inquiry, but as Taylor said, what is important is that everybody should be morally and ethically strong. Everyone has to disclose the truth, even if he or she will be hurt. Everyone should be responsible for his or her decisions and actions. The Senate inquiry would be beneficial to the nation because it could result in legislation that prevents the use of public funds to promote the candidacy of a candidate for any elective post.

Only 2 Cabinet members are upright

MANILA, Philippines—With the exception of only two officials, President Gloria Macapagal-Arroyo's Cabinet is answerable to the bishops' condemnation of "systemic and rampant" corruption in the government, according to former senator and Marcos trade minister Vicente Paterno.

By his standards, Paterno said the only "upright" Cabinet members were Social Welfare Secretary Esperanza Cabral and Defense Secretary Gilbert Teodoro.

Paterno made the remarks during the weekly news forum organized by the Catholic Church on Tuesday, where he was invited as chairman of the Bishops-Businessmen Conference (BBC) along with Cagayan De Oro Archbishop Antonio Ledesma.

"I was a member of the Cabinet of (Ferdinand) Marcos. My assessment is that during the time of Marcos, corruption takes place at the top and trickles down (the bureaucracy) depending on the head of agency," said Paterno in a mix of English and Filipino.

"If the department secretary is upright (matino), his employees will also be upright. If the department secretary fools around (medyo pilyo), his employees will also fool around. So it depends so much on the leadership," he said.

"Now why is there no honest leadership?" he went on. "I don't know if you can find a department secretary who can be depended on. I can maybe choose two," Paterno said.

"If we were to make a poll who among the department secretaries can be considered upright, I can think of two; the social welfare secretary (Cabral) is honest and based on our experience, (defense secretary) Teodoro," he said.

Paterno's remarks came in the heels of the strongly worded statement issued by Catholic Bishops Conference of the Philippines president, Jaro Archbishop Angel Lagdameo and four other bishops calling for "radical reforms" amid the rampant corruption in government.

Lagdameo declared that "the time to form a new government is now."

The bishops' statement was followed by a statement made by the BBC, to which Paterno belongs, assailing moves that will allow Arroyo to stay in power beyond the end of her term in 2010.

Arroyo sent emissaries to meet with Lagdameo on Tuesday.

Lagdameo met for around two hours, from 3 p.m. to 5 p.m. with Budget Secretary Rolando Andaya, Presidential Anti-Graft Commission chairman Connie De Guzman and presidential liaison for religious affairs Nina Valdez at the CBCP headquarters in Manila.

Andaya said they sought the meeting with Lagdameo.

"It's with the blessing of MalacaƱang. Yes, yes of course she (Arroyo) is for this," he said when interviewed after the meeting.

The meeting was supposedly arranged by Valdez on Wednesday, a day after Lagdameo came out with his statement.

Paterno said the bishops' statement against the widespread corruption in the Arroyo government was shared by several other groups. "I think we can say that is a universal sentiment," he said.

"(The bishops) said we need a new government. I say we need a new kind of government. If Mrs. Arroyo can change, then she should do it so that her government will change.

"If she can not change, those who aspire to be president should be conscious that (corruption) is the problem and they should answer to the people," he went on.

Paterno said he had not totally given up on Arroyo.

"It's not a big possibility but maybe there's a chance (she will change)," he said.

Paterno pointed out that the CBCP has been speaking out against corruption since 2006, but the latest has been "stronger because corruption is really prevalent, it has become bigger."

He said the establishment of the Presidential Anti-Graft Commission was just a smokescreen.

"It is just for show, it is not a real drive against corruption," he said.

"We would like it very much if President Gloria Macapagal-Arroyo, Executive Secretary (Eduardo) Ermita and the Cabinet would take what the bishops said seriously. Now they are in denial. How can we change for the better if they are in denial? A government in denial is a government that is not for change," he said.

Andaya said he extended MalacaƱang's offer for the CBCP to partner with them in watching over government projects down to the diocese level.

"We will involve each diocese in the working of the government," he said.

Asked if he asked Lagdameo what he meant by his call to "form a new government now," Andaya replied: "What I understand is, it's all about reforms not about a new government per se, but having a new perspective."

When interviewed separately, Lagdameo said he welcomed MalacaƱang's gesture to inform the bishops what it was doing to fight corruption.

"This is a good start... There's a kind of reaching out to one another," he said.

He said the four other bishops who issued the statement - Lingayen-Dagupan Archbishop Oscar Cruz, Balanga Bishop Socrates Villegas, Masbate Bishop Joel Baylon and Bishop Emeritus Jose Sorra - did not make it to the meeting since it was hurriedly called.

Within Andaya's earshot, Lagdameo said they would not soften their stance against the massive corruption in the Arroyo government.

"No, no, no. We will not change. We will never change,” he said.

Court suspends mayor for graft

Sandiganbayan orders Gov. Enrique Garcia of Bataan to implement preventive suspension

THE Sandigan bayan 4th Division ordered the suspension of a mayor of Bataan and three other Municipal councilors after being charged of graft and corruption by the Office of the Ombudsman.

In a 10-page Resolution of the Anti-Graft court promulgated last October 28, written by Associate Justice Jose Hernandez, it placed Mayor Rolando Tigas of Samal, Bataan under preventive suspension for a period of 90-days.

Besides Tigas, also suspended are Councilors Clemencio Abella, Hercules Llanda and Rafael Guinto pending investigation of the trial of their case at the Sandiganbayan.

With this ruling, the Sandi–ganbayan now moved to prosecute and try Tigas and the other accused for graft in connection with the sale of a parcel of land involving the municipal government of Samal.

The Sandiganbayan also ordered Gov. Enrique Garcia of Bataan to implement the preventive suspension order and inform the court as to the enforcement of the same within five days.

“The governor of the Province of Bataan is directed to implement the preventive suspension of the accused public officers for 90 days. The governor is likewise directed to inform this Court of the action taken with regard to the suspension of the accused public officers within five days from receipt of this resolution,” the ruling says.

Besides Hernandez, other Magistrates who concurred in the ruling are Justices Gregory Ong and Samuel Martires.

According to the Sandiganbayan ruling, it is within the powers of the Court to enforce preventive suspension orders so that the accused will not use their position in the course of the trial and investigation. It would also prohibit them from tampering the records of the case.

He was also afforded due process through the filing of the pleadings to raise the arguments as to the alleged insufficiency of the information.

On September 2, the Sandi–ganbayan junked the motion to quash filed by Tigas afterwhich a petition was filed before the Supreme Court questioning the Anti-Graft court resolution.

Tigas and his co-accused were indicted in court by Overall Deputy Ombudsman Orlando Casimiro and they were accused that they “willfully, unlawfully and criminally request and receive for their own benefit the amount of P513 thousand in connection with the negotiations and eventual sale between the Municipality of Samal and Publio Garcia, attorney-in-fact of the registered owners, of two parcel of lot . . . a contract where all said accused in their official capacity have to intervene under the law.”

The Sandiganbayan ruled that it has jurisdiction to hear and try the case because it is clear in the information that the crime when committed was perpetrated in the performance of his duties.

TACLOBAN CITY, Philippines—Interior and Local Government Secretary Ronaldo Puno finally directed the department’s regional director in Eastern Visayas to serve the suspension order against Samar Gov. Milagrosa Tan.

Puno’s order, received here on Thursday, was in compliance with a directive issued by the Sandiganbayan last July for the DILG to implement the graft court’s order to preventively suspend Tan for 90 days over a pending corruption case.

Puno’s order was for DILG Regional Director William Paler to personally serve the 90-day preventive suspension order issued by the Sandiganbayan, according to Myles Colasito, regional information officer of the regional DILG office.

Replacement

Puno also directed Paler to serve the memorandum order for Vice Gov. Jesus Redaja to assume the post of acting governor for the duration of Tan’s suspension.

Senior provincial Board Member Nancy Rosales is expected to assume the post of vice governor.

Paler will serve the order by Tuesday, she said.

Paler was still in Cebu attending a seminar and would not be back in Tacloban until Monday, Colasito said.

“He (Paler) will immediately serve the suspension order (against Tan) to avoid any speculations that he is delaying it,” she added.

Colasito said their office received the directive from Puno last Thursday. The regional office was required to make a report to the DILG secretary on its action within five days after the order was served to Tan.

Corruption

Last July, the Sandiganbayan directed Puno to implement the 90-day preventive suspension order against the Samar governor who is facing corruption charges.

The suspension order stemmed from the complaint filed by a local watchdog group, the Isog Han Samar Movement, that accused the governor of anomalous purchases of “emergency supplies” worth P1.6 million.

The purchases included rice, medical items and electric fans earmarked for victims of typhoon “Kidang” that hit portions of the province on Dec. 4 and 5, 2001.

However, it was later discovered that some of the purchases were based on requests by municipalities that were made ahead of the calamity itself.

Diversion

It was also noted hundreds of sacks of rice were delivered to Wilmart’s Mini Mart, which is not a registered grain supplier in the said province.

Wilmart’s Mini Mart is located in Tacloban City.

Aside from Tan, also ordered suspended by the Sandiganbayan were provincial administrator Rolando Montejo, provincial treasurer Damiano Conde, provincial accountant Romeo Reales, provincial budget officer Maximo Sison and provincial property custodian officer Numeriano Legaspi.

Members of the Philippine National Police are expected to provide security for Paler and his companions to avoid any trouble during the serving of the order, Colasito said.

The suspension order would be likely served at the provincial capitol or at the Himyangan, the official residence of the Samar governor.

Colasito said it was not necessary for Tan, who is serving her third and last term, to personally receive the order.

AS the United States of America’s President-elect Barack Obama was delivering his victory speech in Chicago, a sense of inspiration and hope began to fill me up. Here was a young African-American, first-term Senator who has defied all odds to become the first Black President of the most powerful country in the world.

Obama campaigned on the message of “Change,” a change that every American could believe in, a change that resonated with so many American voters most especially those aged between 18 to 29 years old. In CNN’s analysis, one of the major factors for Obama’s victory was his charismatic appeal to young voters. This appeal along with his very inspiring words would rally millions of young and previously apathetic American voters to register and take part in the elections.

Obama also showed the world a new way of campaigning, earning hundreds of millions of dollars not by getting big donations from businessmen but by appealing to ordinary people to donate small amounts of $5 to $10 to his campaign. More importantly, Obama’s campaign team was a master of using the power of the Internet and social networking sites such as Twitter, My Space and Facebook thereby being able to relate to the more the younger, tech-savvy generation.

He ended his speech with the words Yes We Can and he showed the world that despite having not enough financial resources or political clout compared to Senator Hillary Clinton and Senator John McCain when he launched his bid for the Presidency more than 2 years ago, he was able to win decisively because he was able to rally ordinary people to his cause.

Indeed, change has come to America and Filipinos can learn much from the experience of Barack Obama since as we draw near to our own Presidential elections in 2010, will we have to content ourselves again with choosing from the same faces or worse, choosing between the lesser evil among the candidates? I hope not.

I look forward to the day that we can also find a true Filipino leader that will also inspire millions of Filipinos to rally for change, a change that millions of Filipinos have been longing for and a change that will hopefully, put an end to the growing poverty cycle that majority of Filipinos have to face each day.

Many Filipinos have begun to lose hope in finding that leader but I think that we have our own little Obamas in our country today such as the likes of Ramon Magsaysay Awardees Mayor Jesse Robredo of Naga City and Gov. Grace Padaca of Isabela, Gov. Eddie Panlilio of Pampanga, Mayor Sonia Lorenzo of San Isidro, Nueva Ecija and Gov. Teddy Baguilat, Jr. of Ifugao.

These local government leaders have defied the odds in their respective areas to win against well-entrenched political dynasties and at the same time, deliver proper basic services to their constituents. Being with them in our group which is aptly named Kaya Natin!, we go around to different colleges and universities to share their stories of hope and change towards inspiring more Filipinos to work for good governance and electing effective and ethical leaders for our country.

Obama was not entirely correct when he said it is only in the United States of America where someone can defy the odds and win, our own Kaya Natin! leaders have shown that Filipinos can also say, “Yes We Can! Kaya Natin!”

Former Congressman and Mayor Gerardo Espina Sr was allocated and received P5Million. Governor Rogelio Espina was allocated and received P5Million. Total P10Million for both of them.

The question is what happened to the money or the fertilizers?

Both need to fully account for the money, if indeed the list will be proven to be accurate once the Senate and the House goes through the report. Further, this will also be included in the investigations conducted by the Office of the Ombudsman.

Rep Glenn Chong needs to put pressure on this issue for the Espinas to account for the money.

Biliran IT center expands

NAVAL, Biliran — The Biliran Provincial Technology Learning Center (BPTLC), a computer learning institution owned by the provincial government, is set to expand with the addition of two branches in the towns of Caibiran and Culaba in this island province.

Biliran Gov. Rogelio Roger J. Espina said the expansion is meant to serve more of Biliran’s constituents, particularly those who do not have the time and resources to go to this capital town for computer literacy training, so that they, too, will gain a competitive edge in the job market.

The provincial government has already submitted a reapplication for registration of the IT learning center with the Technical Education and Skills Development Authority (TESDA), which included the two new branches, BPTLC-Caibiran and BPTLC-Cabucgayan, that are scheduled to open this month.

Along with the two new branches, the BPTLC application for amended registration with TESDA also annexes the special learning program called the Sharing Computer Access Locally and Abroad (SCALA) to the new branches.

Espina said that SCALA is a computer literacy program designed for the poor young people of Biliran, particularly the out-of-school youths (OSYs) and those with disability -- so that they are also given the opportunity to become productive members of the community.

The main BPTLC was established in September 2005 to help Biliranon graduates and even those in the workforce get better chances of finding jobs by making them information technology (IT) literates in computer applications needed by hiring companies, offices, establishments and industries.

It was also designed to provide government and private employees with computer literacy training during their spare time so that they would become more productive in their respective jobs; and to compliment the capability of the educational sector to teach IT subjects.

The main BPTLC is located at the Museo de Panamao Building at the capitol compound in this capital town.

Eastern Visayas to miss palay procurement goal this year

PALO, Leyte — The National Food Authority (NFA) office for Eastern Visayas said state palay procurement will fall short of target, as farmers — especially those indebted to their buyers — have been selling more to private traders.

As of last month, NFA bought just 14,412 50-kilogram bags of unhusked rice in the region, against a target of 53,000 Lkg bags for the year.

NFA regional information officer Mary Agnes Militante said that out of the six provincial offices in the region, Biliran posted the highest procurement volume with 9,416 Lkg bags. NFA bought only 2,981 Lkg bags in Samar; 1,680 Lkg bags in Leyte; 243 Lkg bags in Southern Leyte; 60 Lkg bags in Northern Samar; and 32 Lkg bags in Eastern Samar.

Benjamin Marta, NFA regional director, said it would be hard for the region to meet its procurement target this year despite the higher buying price, incentives and intensified campaign.

"We were surprised by the low procurement in the region, even with our massive campaign," he said in an interview late last week, noting that private traders in the region offered to buy palay at P13-P18 per kilogram, compared to NFA’s P17/kg. — S. Q. Meniano, BusinessWorld

I heard from a reliable source that Michael A. the manager of RN exposed some facts that the Espina dynasty is free of charge from broadcasting over RN. That is the conditions before the permit was issued. All their ads and programs including the Timbangan and JDR’s too are free of charge. During the conference, Atty. Mejarito expressed his desire to make the VOTERS EDUCATION by the COMELEC and POLITICAL EDUCATION by the church to be merged in preparation for the 2010 election. However, the church representatives said that there is no problem as long as the Social Teaching of the Church and its moral principles will be included.

Atty. Mejarito was very negative about this condition given by the church representatives. He said that the COMECLEC has already its own guideline as regards to VOTERS EDUCATION.

The church in Naval is willing to work with the COMELEC in preparation for the 2010 election but the COMELECT is very hesitant because of the said conditons.

The way I see it, Atty Mejarito cannot really commit COMELEC into the condition imposed as not all voters belong to the Roman Catholic Chiurch. To agree would be prejudicial to other denominations and other religions.

COMELEC's voters education initiative will focused on the legalities and technicalities of the voting process. the Catholic Church, on the other hand, should focus on the moral issue of the voting process.

Region 8 (Eastern Visayas) has been "blessed" with more than 30 farm-to-market road projects – more than many other regions of the country – but most of the projects are way behind schedule.

Worse still, some contractors have practically abandoned their projects after getting the initial payment for their contracts, reports stated.

"It’s such a shame that these vital programs that are designed to help lift the poorest of the poor people of Eastern Visayas from horrifying poverty cannot be used because they remain unfinished," said a source at the InFRES who requested that he not be identified.

Some contracts have been extended two or more times, apparently to accommodate the political cronies of project implementers, notably local government officials.

Under the InFRES program, the national government foots the bulk of the funding for the farm-to-market road, while the local government unit (LGU) puts up a certain percentage of the cost of the project, depending on the income of a municipality.

The poorer the municipality, the smaller its financial exposure (counterpart fund) in the project.

Ironically, although national government investments in farm-to-market road projects under the InFRES program are far bigger than those of the recipient LGUs, the latter pick the contractors and exercise overall supervision over the implementation of the projects in keeping with the concept of empowering the LGUs.

This setup has led to charges that the implementation of farm-to-market roads has been hobbled by politics and corruption, thus resulting in massive delays in the completion of the much needed pro-poor facilities.

"The fate of many national government-funded countryside projects is entirely in the hands of LGU officials and, unfortunately, many of them have turned out to be a lot less sincere in helping their constituents than they claim to be during the election campaign," the source said.

Coalition Against Corruption Statement


CALL TO ACTION AGAINST CORRUPTION

Corruption is the gravest threat to Philippine democracy and society today.

In the Millennium Challenge Corporation’s just released Philippine scorecard for fiscal year 2009, the country failed to meet the performance standard in the control of corruption category, with its percentile ranking falling to 47% from 57% in fiscal year 2008.

In the 2008 Corruption Perceptions Index released by Transparency International in September, the Philippines placed in the bottom quarter of 180 countries. The country tied for 141st place with Cameroon, Iran, and Yemen.

The country’s poor performance in these corruption ratings is not surprising given the litany of scandals that have hounded the current Administration since 2001: the IMPSA kickbacks, the AFP comptroller hidden wealth case, the Jose Pidal scandal, the COMELEC-MegaPacific computerization deal, the fertilizer scam, the North and South Rail projects, the cheating in the 2004 presidential elections, the distribution of cash gifts in MalacaƱang, the NBN-ZTE bribery scandal, and now, the PNP “euro generals”. No one has been held accountable. We have not witnessed corruption of this magnitude since the years of the Marcos dictatorship.

Contrary to her pronouncements, the President has shown no intention of using the considerable powers and resources at her disposal to get to the root of all these scandals, and has in fact allowed the misuse of her power of executive privilege to hinder investigations into acts of official corruption.

The unchecked rise of corruption is seriously hampering efforts to reduce poverty in the country and affecting our economic competitiveness. But most alarming is the moral impact of this virulent cancer on our citizenry, especially the youth. Not only is it fostering a sense of cynicism and desperation, the greater tragedy is that it may be engendering the adoption of the corrupt’s disoriented moral compass among our people.

In their call to action, the group of bishops led by Jaro Archbishop Angel Lagdameo asked, “But, who, who will pick up the broken, shattered pieces of our country, hurting from poverty and corruption, to make it whole again?” We say, we Filipinos are our own liberators. Despite the dire situation we are in, we believe that we are not powerless to defend the integrity of our institutions and values. We urge all Filipinos to join us in challenging our political leaders to immediately undertake the following reforms:

* Implement citizens’ participation in local development planning and budget reviews. We urge our public officials to recognize their constituents’ right to participate in governance. Citizens should know how public funds are being used in their barangay, city, and province.

* Strengthen the civil service. We need civil servants who will build quality and integrity systems in government agencies, and spearhead the campaign against corruption from within the bureaucracy.

* Punish the corrupt, not the whistleblowers. Except for General Carlos Garcia, no one has been held accountable for their misdeeds. We strongly urge the Ombudsman to act on pending high-profile corruption cases, to increase the office’s pool of competent field investigators, and most importantly, to uphold her mandate to serve as protector of the people and not of the powerful.

Let us end the culture of dishonesty and impunity in our country, especially in government, and take the war against corruption to the forefront of the national agenda!

against Malay mayor, officials

Ombudsman finds illegal the construction of a hotel/resort in Boracay

THE Office of the Ombudsman Field Investigation Office (FIO) filed administrative and criminal charges against the Mayor and other officials of the municipality of Malay, Aklan for allowing the construction of a hotel-resort in a protected forestland.

With the said order of the Ombudsman FIO, a formal preliminary investigation shall be conducted by the Ombudsman Preliminary Investigation Administrative Adjudication Montoring Office for charges of violation of Section 3(e) and (j) of Republic Act 3019 (The Anti-Graft and Corrupt Practices Act, RA 1586, An Act Proclaiming Certain Areas as Environmentally Critical) and Presidential Decree No. 705 (Forestry Code) were recommended against Ceciron Cawaling, Mayor; Engr. Elizer Casidsid, Municipal Engineer; and Alma Belejerdo, Zoning Administrator, all of Malay, Aklan; Jesus King, Barbara King, Richard King, John King and Rafael King, incorporators of J. King and Sons Co. Inc., contractor of the project.

In the fact-finding probe, it was disclosed that Cawaling, Casidsid and Belejerdo were also recommended to be administratively charged for gross neglect of duty, gross misconduct and conduct grossly prejudicial to best interest of the service for their failure to stop the construction of Boracay Crown Regency.

The Ombudsman investigative office also recommended that Cawaling, Casidsid and Belejerdo be placed under preventive suspension pursuant to Section 34 of RA 6770 or The Ombudsman Act of 1989 in order to prevent them from tampering the records of the case in the conduct of the investigation.

Under the law, if the respondents were found guilty, they may face imprisonment of up to 15 years, perpetual disqualification from public office and confiscation or forfeiture in favor of the government of any prohibited interest and unexplained wealth manifestly out of proportion to his salary and lawful income.

The case originated from a complaint lodged by the Department of Environment and Natural Resources (DENR) which says that the Boracay Crown Regency and Convention Center is being constructed on a piece of wetland which falls within the classification of protected areas by the DENR.

Contractor J. King and Sons Co. “did not comply with the requirements of environmental laws prior to the construction of the Boracay Crown Regency,” and that the respondent local officials were “negligent in suspending the construction are likewise liable in the issuance of the building permits without the required Environment Compliance Certificate.”

Based on the physical assessment conducted by the Protected Areas and Wildlife Division of the DENR revealed that the said area is a wetland, as evidenced by the slightly saline or brackish waters, lush shrubs and mangroves, and the various species of fish found there. In addition, the locals called the said area as “lasinan,” or an area used for making salt, and is connected to the Dead Forest, an opening to the sea.

The respondent local officials were also accused by DENR for having been negligent in implementing Resolution No. 042 issued by the Sangguniang Bayan of Malay, which was issued in response to the DENR’s call for a moratorium on new construction of structures/buildings in Boracay. Records showed that the said resolution was enacted on September 26, 2007 and signed by Cawaling on October 10, 2007.

Cawaling only directed Casidsid and Belejerdo to implement the said resolution on January 2, 2008.

MANILA, Philippines - A former governor of Antique province was convicted of graft by the Sandiganbayan in connection with the anomalous purchase of P5.67 million worth of school desks and armchairs in 1997.

Facing 10 years imprisonment is Jovito Plameras, who is also ordered by the anti-graft court’s Third Division to reimburse the provincial government P2.65 million for the undelivered desks and armchairs.

The 49-page decision was penned by Associate Justice Efren dela Cruz and was concurred by Associate Justices Francisco Villaruz Jr and Norberto Geraldez.

The case was based on a complaint filed by Antique Rep. Exequiel Javier, who accused Plameras of signing a purchase agreement with supplier CKL Enterprises on April 7, 1997 without any public bidding or an authorization from the Antique provincial board.

Under the contract, CKL was supposed to deliver 1,354 desks and 5,246 armchairs all worth P5.67 million. Delivery was supposed to be completed within 180 days from perfection of the contract.

Without waiting for the delivery, the accused signed Sales Invoice No. 0220 acknowledging receipt of the correct number of desks and armchairs “in good order and condition” and accepted Land Bank of the Philippines Craft no. DB97121.

The said documents enabled supplier Jesusa T. dela Cruz from CKL Enterprises to withdraw from the province’s bank account the full value of the contract even if the delivery was incomplete.

Plameras claimed he thought public bidding was no longer required because a representative from the Department of Education, Culture and Sports (now DepEd) allegedly told him such a procedure is no longer necessary. He however failed to identify the supposed DECS official in his testimony.

The Sandiganbayan was unconvinced with Plameras’ defense.

“The accused himself knew that public bidding was required. It bears emphasis that the accused was not born yesterday. He is a seasoned public official and, at the time of the transaction in question, was a governor of the Province of Antique, not to mention that he is also a member of the bar,” the Sandiganbayan said.

Likewise, it noted that Plameras used an “unwarranted and improper speed in causing payment” to the supplier because payment was approved on April 24, 1997, while the initial delivery of the desks and armchairs were made on June 10, 1997, or two months later.

The Sandiganbayan said Plameras gave unwarranted benefits and advantage to the contractor while causing undue injury to the province of Antique.

“Every government official must learn by heart that a pbulic office is a pbulic trust. Faithful compliance with the law is a vital duty which every public official has to observe. Nothing less is expected. Lamentably, the accused failed to live by the standards expected of a public servant,” the anti-graft court said. - GMANews.TV

I have received information from reliable source that Governor Roger Espina has given a written commitment to the Catholic priests in Biliran not to authorize any more mining operations until the end of his term.

This does not mean however that we become complacent in our vigilance against any more attempts to conduct mining operations without due public information, compliance to the Mining Act of 1995, and without proper safeguards to any form of environmental disaster.Better still, let us say no to mining.

The plan to form an action group for Greenpeace will continue. Please email admin to signify your interest to join the movement. Meantime please visit Greepeace website and join as online activist.

The revocation of the mining permit for the sulfur mining does not absolve the government officials and employees involved from wrong doing. The inquiry must be conducted and share of the income derived as mandated by law needs to be accounted for.

Let put a stop to this corrupt practices of granting rights to cronies who are prepared to pay off our elected officials to exploit our natural resources. Let us put a stop to the abuse of power that our elected officials have exercised for their own benefit not the Biliranons.

Let demand for honesty, transparency and accountability from our elected officials and government employees where the public resources and funds are at stake.

BAGUIO CITY, Philippines -- Ombudsman Merceditas Gutierrez on Friday helped form a national association of volunteer ombudsmen to help reform a corrupt bureaucracy by monitoring agency activities in the provinces.

But a survey of these new personnel who would monitor the bureaucracy has given Gutierrez pause.

Asked to rank their capacity and their work expectations, about 400 delegates to the first National Convention of Regional Ombudsman graded the job of investigating complaints and of monitoring bids and awards processes among their lowest priorities.

Topping their anticipated work priorities were anti-corruption information and prevention drives.

Gutierrez said she has been trying to widen the reach of the Office of the Ombudsman during the times she absorbed criticism from legislators for allegedly sitting on complaints against former Justice Secretary Hernando Perez and former Agriculture Undersecretary Jocelyn Bolante.

She said only 100 fact-finding investigators and prosecutors are handling about 21,000 cases in her office.

She said the work load is certain to grow next year because it is election year.

"Ay naku! May mga harassment para ma-prevent itong kandidato from running. Ang iba diyan iisipin para wala na silang kalaban kasuhan na natin (There would be harassment cases to prevent a rival candidate from running. They will think filing cases would deter political rivals)," she told the Inquirer here on Friday.

The volunteers are taking on additional chores for their respective agencies without pay, she said.

"We don't have organic [full-time] employees, resident Ombudsman employees in the Philippines. We want to have as many resident ombudsmen as the [Commission of Audit's team of resident auditors]…to make a dent. They [would be] watching how contracts are being negotiated and implemented in their agencies," she said.

Lawyer Rafael Hipolito, director of the Bureau of Resident Ombudsman, said only 11 resident ombudsmen monitor 43 government agencies, as well as state companies.

"If you have a resident ombudsman and a resident auditor, it would be very difficult for people to commit corruption. Dalawa na ang nagbabantay (We’d have two watchdogs)," Gutierrez said.

The survey results help the Office of the Ombudsman define a code of conduct that would guide the volunteers, said Hipolito.

He said the survey, which was conducted last week, helped them build a profile of the duties they would want to concentrate on.

Ferdinand Mendoza of the Ombudsman Research and Special Studies Bureau said all 400 delegates were asked to rank the following duties: anti-corruption education promotion; corruption prevention systems review; bids and awards committee observation; investigation; public assistance; networking and dialogues.

He said 39 percent of the delegates who were surveyed ranked public assistance among the jobs they expected to invest time and resources as volunteer ombudsmen.

Mendoza said 23 percent marked anti-corruption education and promotion at the top of their list of preferred duties.

He said 48 percent of those surveyed had at the bottom of their list of duties the task of BAC observer and investigation.

Deputy Ombudsman Orlando Casimiro said the task of investigating has its risks, if the person in charge of pursuing agency wrongdoing belongs to the same office.

He said this explains why volunteers do not consider this task a top chore.

"Performing investigative functions in the agency would also jeopardize their career movements," Hipolito said.

The task of investigation is a fact-finding job and the 400 volunteer resident ombudsmen are required only to provide the government leads, he said.

"Some people complain that the fact-finding investigation takes too long…It takes the National Bureau of Investigation a long time [to do the same job]. You conduct discreet investigation before it is transmitted to the Department of Justice for prosecution," said Gutierrez.

Your observation is valid. It is acutally both, to make money for themselves and to raise funds for the forthcoming 2010.


This is an emerging serious problem, that if not nip in the bud, will lead to more abuses to our beloved Biliran.

We have to remain vigilant and be pro-active in pre-empting any form of corruption which will allow unsavory characters among our elected politicians and government officials to illegally exploit our natural resources for their own selfish benefit.

It is not limited to the mining activities, there are a lot of ways that these insensitive mongrels, using their position in government, can abuse Biliran's treasures.

Actually, I read the copy of Gov. Roger's letter to stop the mining activity in Caibiran. But this letter is only a letter because until now Sulpur Mining is still on operation. According to the oreration head, the company has to retrieve their expenses especially that Gov. Espina asked an amount of 3million to grant the mining operation.

I will request the Freedom Fighters on the ground to take a current video and photographs showing dates and time of the take.

It is really a matter of Governor Espina enforcing his revocation order. If he cannot enforce it then it simply means, that it is just a show. It may also confirm the suspicion, that indeed there was an exchange of a substantial amount of money which has emboldened these operators to defy Gov Espina's order.This does not augur well for the Governor.This will give the anti corruption fighters more ammunition to fire. The ball is in his hands.This further shows that he is losing control over these operators.

He is digging his own grave, so to speak.

Today, as the world observes International Anti-Corruption Day, we urge you to commemorate this occasion by taking stock of the Office of the Ombudsman’s implementation of its mission to “promote integrity and efficiency
and high ethical standards in public service through proactive approaches in graft prevention and public assistance, prompt investigation of complaints and aggressive prosecution of cases filed against erring
public officials and employees.

As we take a close look at the Office of the Ombudsman’s track record under your leadership, it is with deep dismay that we note the following:

1. the inaction or downright mishandling of high-profile cases involving large-scale corruption that have
been brought before your office. The cases relating to the Nani Perez-IMPSA kickbacks, Comelec-Megapacific
computerization deal, Joc-Joc Bolante fertilizer scam, and overpriced Cebu lampposts, to name a few, have
floundered or been dropped due to technicalities.

2. the failure to improve the Office of the Ombudsman’s organizational capacity to efficiently perform its
investigative and prosecutorial functions. After your office received support funds from development partners
and the budget department, were you able to hire and develop more field investigators and prosecutors? Is it true
that talented lawyers are leaving your office because there is no merit system for investigators, prosecutors, and
staff who are doing excellent work? What happened to the case tracking program that was developed for the
Office of the Ombudsman?

3. the downtrend in the control of corruption indicators and sincerity rating of the Office of the Ombudsman
in international and local surveys. Though it is easy to brush aside these surveys as measures of perception
and not reality, the common view is that corruption has worsened and that you have yet to prove that you are
fully committed to fulfilling your mandate. More alarming is the widespread perception that you have been less
interested in prosecuting erring public officials than in protecting them.
At this juncture of our nation’s history, when the problem of corruption has become one of the gravest threats to
Philippine democracy and society, the Office of the Ombudsman is being called upon to be a paragon of
independence and objectivity, to stand up for the rule of law, and most importantly, to be on the side of right.
Will you finally rise up to the profound challenge and responsibility of your position? Or shall you continue to
stand by and allow the reign of brazen corruption to hold sway over our country?

Gov’t corruption alarming, says Ombudsman

Ombudsman Merceditas N. Navarro-Gutierrez said yesterday that corruption in the bureaucracy has reached alarming proportions and is causing the government to lose more than P20 billion a year.


Without mentioning specific cases, Gutierrez said the number of graft complaints filed daily indicated corruption has become "too much.’’

Gutierrez made the admission before more than 5,000 government officials and employees at the launch of the first National Summit on the United Nations Convention Against Corruption at the ULTRA gym in Pasig City.

The Philippines is a signatory to the convention and the occasion was timed to coincide with the celebration of International Anti-Corruption Day.

"This is the day for all sectors of the society to join hands in fighting corruption to save our people from the quagmire of poverty,’’ she said.

The Ombudsman cited a study by the United Nations which said that the Philippine government is losing as much as R20 billion a year through under-the-table deals.

Gutierrez said lots of people have been criticizing the Office of the Ombudsman and her person without knowing what the agency has done to combat corruption through a string of prevention and prosecution projects.

She said ordinary citizens can help in fighting corruption in all levels of society by filing criminal and administrative complaints before the Ombudsman and providing available documents and evidence.

"If affidavits are not available the complainants may identify such documents so that we can subpoena them,’’ she said.

In filing denunciations of corrupt government personnel, Gutierrez said the complainant may not identify himself or herself to avoid reprisal and harassment.

I have been informed by Jalmz that the sulfur mining area has now been vacated and there is no visible signs of equipments, trucks or workers.

The pressure is building up. However, the revocation of the permit to operate does not absolve the people behind this fiasco from any wrongdoing, if proven.

Maybe, jalmz is true because i also heard the same report that sulfur mining is partially vacated. I will personally visit this mining site tomorrow if I have a time.

The governor has no choice because he had been pressured by the clergy in the diocese of Naval. Last Dec. 4,2008, during their regular presbyterium meeting, the clergy invited the governor for a dialogue regarding the sulfur mining after the later issued a letter of suspicion but still the mining is going on. So the clegy decided to invite the governor for a dialogue. As usual, the governor never appeared, instead, he sent a representative Jun Dacillo.

The clergy voice out their frustration and leave a message that the governor is a great liar. After this dialogue,there was a report that the operation was stopped and maybe temporarilly because the owner will secure a national permit from DENR.

It does not mean, however, that what happened was alright and everything is forgotten. A slap on the wrist was all that Gov Rogelio Espina got from the Clergy. No inquiry as to the circumstances of the grant of the permit not even pinpointed who were the personalities involved. To top it all, no one even asked how much and where the money collected from Ranulfo Kuizon as legal share of the government.

The continued abuses and corruption in the local government setting is caused by the fact that no one has ever been been taken to court and convicted in spite of blinding evidences.

I am deeply concerned that until now, there are no developments in the alleged case of graft and corruption filed by Mr Charlie Chong against Gov Rogelio Espina.

Indeed, a civic action group should initiate the filing of cases against any elective public officials and government employees found to be involved in graft and corruption.

It is difficult for an incumbent official to initiate the filing of case as it will be merely interpreted as political maneuver for the next election.

Biliranons must take the next step towards taking concrete action. You can dramatize the awareness by educating Biliranons about the evils of graft and corruption, but without concrete steps taken to punish the culprits, it will simply fade to oblivion.

I hope that this case of the growing awareness of the Biliranons on the mining issue will contribute towards precipitating an affirmative action geared towards getting the people involved to be held accountable in the court of proper jurisdiction.

Otherwise, a slap on the wrist is nothing but a temporary lull in the culprits' plan to mine Biliran's resources for their own selfish interests.

I personally visited the place where the Sulfur mining was operated. Although it was hard to reach the place because of muddy road due to regular rain everyday but we still continue to climb up to the place. The mining was temporarily stopped. It was really a large scale of mining because one the Caibiran mountains was totally destroyed. If you really want to preserve our environment and its natural resources and if you really love our Biliran Island, you would feel so much pain.

While the action of the local church in the Diocese of Naval is laudable, it should now result in a more effective ban against mining and lead as well to a united move by the people of Biliran to get the justice they deserve by making the guilty party pay and be responsible for their environmental crimes against the people and mother nature. The damage against environment is enormous. They must have to pay the destruction.

Yesterday, Dec. 15, 2008,Hon. Roselyn E. Paras led the youth of Naval during the motorcade around the town. She personally organized this youth program of course for her political purposes. At least, 10 representatives from every barangay of Naval hauled by their own trucks. One of the youth representatives told us that most of the youth delegates are sons and daughters of FOGE.

Thank you for the update. The people involved in this fiasco simply got a slap on the wrist from the Church.

That is the problem with us Filipinos, we have short memories. We tend to forgive and forget, not punish. Corrupt officials exploit this weakness knowing that they will never be held accountable for their acts.

Until now, only Rep Glenn Chong has released an official statement on the mining issue.

The Office of the Governor,Sangguniang Panlalawigan, DENR, Mayor of Caibiran and Kagawad of Pulang Yuta, are simply stone walling the clamor for the truth. They expect the issue to go away knowing that Christmas holiday is coming, and they can always rely on the "ningas kugon" attitude of the Biliranons. Come January 2009, everything is forgotten and they can go on with their merry lives, with plenty of money in their pockets.

That may be possible, if Gov Rogelio Espina is cleared by the Office of the Ombudsman; and Gerry Espina Sr et Al, escape possible conviction on the ambush case.

Nevertheless, Espina Dynasty is preparing for the best and worst case scenarios.

It is up now to the Biliranons, if they want a re-hash of the 12 years of full Espina Dynasty control; and 15 years of partial control up to 2010.

Honestly, Biliranons need to be pro-active to insure that they are well represented in public office, not just by one family.

I know that major political change in our province does not come from within the wall of one’s intelligence, although it helps, but it must come from own political struggle for real change through political education. It is a process that required the full participation of passionate and patriotic citizens. Thomas Jefferson said it best: “The People are the only sure reliance for the preservation of our Liberty.”

I apologize for the lengthy absence. I have taken a sabbatical from blogs including BI in the past months as I think it sometimes help me look at the Biliran situation from a distance.

It is heartwarming to know that the struggle continues and our allegiance to Biliran and the Biliranons is still our top priority.

Thank you for the kind comments on my past blogs and I hope that we will continue to exchange ideas on relevant issues that will help us educate Biliranons to make more informed decisions.

I would like to congratulate Fr Bing Colasito and the founding Members and Officers of BAGGAT-CPC for taking this bold step. I would also like to extend my heartfelt gratitude to Mr. Edward Gacusana of CAC Manila and Dr Rolando Borrinaga for helping in its formation.

I certainly hope that BAGGAT-CPC will give the Biliranons the opportunity to be represented in insuring, that the prequalification, bidding and implementation processes of any projects involving public funds in Biliran will be honest, transparent and can be fully accounted for. It is a very difficult task and I hope that Biliranons will support this initiative for our own good.

One of the reasons for the underdevelopment of Biliran and the hardships Biliranons continue to endure is the lack of public funds lost to corruption as a result of violations to established bid and award processes.

MANILA, Philippines – The provincial treasurer of Laguna Tuesday filed plunder charges against Laguna Gov. Teresita Lazaro for allegedly amassing some P50 million in ill-gotten wealth through alleged anomalous transactions favoring “dummy” businesses of her family.

Treasurer Manuel Leycano Jr. also filed a complaint against 21 other provincial officials, including Lazaro’s son Dennis who serves as provincial administrator, for allegedly conspiring to allow the allegedly anomalous transactions in the province since 2002.

Like others said, it is great to have you back with us, and I want to salute you for being a real biliranon.

Net blogging is great, and can be very satisfying. It's a wonderful way to meet new people, especially people we may not meet personally. Most of my blog friends are from other countries, and maybe some of them came from my beloved province.

Meeting people and knowing them physically is the easy part. But making friends and keeping them in the net can be as hard here as elsewhere, and requires time and effort. But so many of the people I meet in the net seem as though they would be good friends - so we make the effort to get to know them better only through the way their good ideas are presented and also the way a person communicates his/her opinion, then a correspondence starts, each message reflects one’s personality - and so on.

Political climate now in Biliran is becoming erratic. The Espina dynasty moves left and right to destroy the image of Rep. Glenn Chong and Mayor Susan Parilla. Their cronies known as 15/30 are penetrating mostly in the barangays of Naval to discredit Mayor Susan’s performance.

Maybe the reason is because they are a deeply unprincipled politicians who destroy their political opponents and those whom they view as a threat to their power — and in this case, their political opponent happens to be a graceful man and a rising political star.

Now that the Espina couldn’t beat Rep. Glenn in the realm of ideas, they had to attack his personal life in a vicious matter. He and Mayor Susan Parilla might become a victim of the new style of their political attack machine. I'm sure their evil moves will no be successful.

The demolition job instigated by the evil on my person did not only destroy my image in public, it also destroyed all the hopes of the poor children and students who believed in the cause of the free school bus system and the adopt-a-child project as a means to give them greater achievements in life. Nevertheless, allow me to clarify the issues hurled by the Timbangan against me.

1. On the Buses’ corporate sponsorships. Is there anything wrong with the idea? By doing this we can at least defray the cost of diesel, so we will not have to rely so much on Rep. Glenn Chong’s PDAF to keep the buses in service. For as long as there are corporate sponsors and paid ads, we can be assured of the buses’ sustained operation.
2. On the Adopt-A-Child Project (ACTF). This volunteer NGO has its own set of officers (including BOD Chairman and treasurer). I am only acting as a Volunteer Coordinator of the project and religiously followed all the policies agreed upon by the BOD. At the moment the project has trust fund of P3.5M deposited at LBP-Naval and only the quarterly interest income or about P326,000 annually can be utilized to purchase school supplies for the pupils. Since the interest is not enough to support the 12,000 pupil beneficiaries all over the province, we solicited financial support from private individuals, businesses and some barangays so we can distribute at least P150 worth of supplies to each pupil in every start of classes. This project is governed by rules and accounting procedures and therefore all transactions are fully accounted for. We are accountable to our donors and not to the government.
3. On the P1M foreign aid to purchase school bags. That is a big lie. There is no foreign aid. All the P26,500 school bags were purchased from the Rep. Chong’s PDAF.
4. On being used by a politician. The ACTF is a volunteer and private NGO. There are no laws prohibiting us to implement our project in partnership with politicians with similar disposition.
5. On the question of my credibility. Well, I am already 39 and ever since have utilized every hour of my life in initiating, inspiring, mobilizing and organizing people and activities that will have impact in the lives of the poor. But despite that, I remained a “nobody”. I am just a simple person who avoids publicity in all my endeavors.

I don’t care the less if people say negative things about me. For as long as I am doing what is right and with a sincere heart, no amount of negative publicity could bother me. The Timbangan people doesn’t really know me and my ideals (mao nga nakasulti silag dautan kanako), and I for that I forgive them. After all, in all my undertakings, my intentions is not to look good before the public, but to do what is good for God’s greater glory.

It's good that you will ignore it. Theses guys – Timbangan, are idiots, they used to express offensive terms that deliberately insults your intelligence and moral credibility.
Broadcasting a dumb comment from time to time on the radio is one thing a very stupid attitude. When a person regularly said unfounded comments, the problem clearly is the person. I know some people are open to critique but most folks are not. Bad ideas that have traction should be rebutted, attacked, opposed… pick your verb. Bad comments that are baseless should be ignored.
The problem I see is there are too many inexperienced radio commentators like the timbangan who cannot tell the difference between constructive and destructive comments. I know for a fact that these guys are used by the frustrated politicians as demolition team. Now, its time of Lent, time for humility, time to express forgiveness and a time to pray our detractor. Cheer up!

It is unfortunate that in the guise of freedom of speech, Gerry Espina Sr and his clowns continue to sow disinformation to the public to keep their political ambition alive.

I have listened to Gerry's pod cast, and it reveals a broadcast of a fading but trying hard politician who wants to hang on to the memories of power he used to wield when he was in full control of Biliran.

These recent attacks on the individuals associated with BAGGAT-CPC are clear indication of the level of desperation Gerry Espina is now experiencing in his political career. After all, politics is his sole means of livelihood.

His explanation of where Gov Roger Espina raised the funds to finance Biliran Garden Resort is an insult to the intelligence of the Biliranons. Almost all members of his family and extended families are all government employees and as such their income are ascertainable. If Gerry is serious about proving, that the funding for the resort did not come from any public funds, he must open the books of the company to public scrutiny and allow investigators to look into the loan Gov Espina supposedly obtained from the finance institutions he mentioned in his broadcast.

At any rate, given the time, Gov Roger Espina will be compelled to open the books in the very near future.

SAN JUAN, Batangas – (UPDATE) MalacaƱang is confident the Office of the Ombudsman would act “faster” on other graft cases after recommending the filing of charges against 17 incumbent and former public works officials allegedly involved in rigging bids for World Bank-funded infrastructure projects.

At the same time, Presidential Political Adviser Gabriel Claudio welcomed the Ombudsman’s resolution issued on Wednesday, two months after the allegedly rigging of the bidding for the projects was exposed and ordered investigated.

”It's encouraging to note that the Ombudsman has been able to come up with its findings and conclusions and actions on the controversy on the case within a relatively short time,'' Secretary Gabriel Claudio, presidential political adviser, told reporters here.

“I think there’s every reason for us to be confident that the Ombudsman would be moving faster on the other cases filed before them,” Claudio told reporters here.

Claudio also refuted speculation the Ombudsman’s move was meant to stop further criticism of government over the alleged anomalous bidding, saying, “This is not for show.”

“I’m sure the dispatch by which the Ombudsman has acted on this particular case has nothing to do with wanting to stop further allegation or cases being filed,” he said.

Former secretary Florante Soriquez, current undersecretary Manuel Bonoan, and the other officials involved in at least six bidding processes for Phase 1 of the National Roads Improvement and Management Project (NRIMP-1) could also face charges of grave misconduct and neglect of duty, among others.

MANILA, Philippines - Sen. Panfilo Lacson could face criminal charges for harboring a fugitive, Justice Secretary Raul Gonzalez said yesterday.

Gonzalez pointed out Lacson had hired Reynaldo Lopez Oximoso as his driver, the same person who has an outstanding warrant of arrest for multiple murder. Oximoso reportedly drove the vehicle where the supposed conversation regarding the hit on publicist Salvador “Bubby” Dacer took place.

Gonzalez said Lacson had admitted hiring Oximoso as his driver, who issued a statement claiming that he does not remember former police superintendent Cesar Mancao or former senior superintendent Glenn Dumlao riding in the car.

Gonzalez noted Lacson had failed to mention Oximoso has a standing warrant of arrest for multiple murder.

Internet use in RP expanding to lower income groups

A total of 28 percent of Filipinos in national urban Philippines are regular Internet users with five percent of users saying they access the Internet everyday, a survey by the Nielsen Company and Yahoo Philippines revealed Thursday.

The survey, conducted from October to November 2008, said Internet usage in urban centers has grown from 20 percent in the first quarter of 2008 to 28 percent by the end of last year. He said there are an estimated 35 million Filipinos in urban centers nationwide.

Jay Bautista, Nielsen Company executive director for media, said Internet cafes have become an important access point for Filipino Internet users with 71 percent of the country’s estimated 20 million Internet population saying they have accessed the Internet through e-cafes in the past three months.

Great equalizer

He said affordability of access, either through Internet cafes, cheap netbooks and PCs, and cheap broadband is increasing the local Internet user base. He added, however, that Internet cafes are clearly favored by majority of the youth and people in the D and E socioeconomic classes.

“Internet cafes have become the great equalizer for all social classes in accessing the Internet. Forty-seven percent of all Internet time by Filipino Internet users are spent in Internet cafes. It’s the only medium that allows you to communicate, do research and even entertain you for 10 to 15 pesos an hour,” Bautista told abs-cbnNEWS.com.

The survey showed that 71 percent of Filipino Internet users accessed the Internet through Internet cafes in the past three months, 27 percent said they accessed it at home, seven percent said they accessed it at the office, and seven percent accessed it in school.

Eighty-one percent of Internet users from Class CDE said they are regular Internet cafƩ users compared to 21 percent from Class ABC1 and 27 percent from Class C2.

Bautista said the Yahoo-Nielsen Net Index Initiative is the first ever in-depth study of Filipino Internet users across 22 major cities in the Philippines. The survey was conducted using face-to-face interviews of 1,200 respondents aged 10 and above across all economic classes who have used the Internet at least once a month.

Young Internet base

The survey also revealed that the younger generation have become early adopters of the Internet. At least 49 percent of Internet users in the Philippines are ages 10-19 while 32 percent are ages 20-29.

Fifty-percent of Filipino Internet users ages 10-19 years old said they accessed the Internet at least once in the past month.

The survey also showed that Internet use in the Philippines is not restricted just to the big cities like Metro Manila. “For example, 35 percent of Filipinos in Cagayan de Oro have accessed the Internet in the past month,” Bautista said.

The survey also showed that 55 percent of all online users are from Class D socioeconomic class.

The survey also showed that Filipino Internet users are more likely to be opinion leaders and early adopters compared to traditional media consumers. They are likely to be individualistic, trend conscious, willing to pay for quality products, and are tech enthusiasts.

The survey also showed that e-mail, instant messaging and search are the most common online activities for Filipino Internet users. It said Yahoo is the dominant web-based e-mail, instant messaging, and search service in the Philippines.

It also showed that online gaming and social networks are becoming more common online activities for local Internet users. The survey said 53 percent of Internet users play online games. They are likely to be males and below 20 years old.

Bautista said social networks have become an important tool in communicating with friends and family. Fifty-one percent of local Internet users said they access social networking sites every month; 92 percent said they have a Friendster account.

The survey said 42 percent said they read a blog in the past month with at least one in three Filipino Internet users saying they have a blog.

The survey also showed offline texting is moving online. The survey showed 23 percent of Internet users regularly send text messages via the Internet.

On the other hand, online transactions or commerce remain low. Only three percent of Internet users conduct online banking activities or make online purchases.

He will need to give assurance to the Biliranons that no one from his immediate family will run for any elective position in 2010. It is hard enough fighting the Espina Dynasty how much more if Rep Chong succumbs to the temptation of putting up any member of his family in the guise of "no one else is capable" rationale. He must dispel these rumors that Mr. Charlie Chong is contemplating of running for Governor. He has one year to scout for able and winnable candidates and solidify his party.

Let us stop family political dynasties in any shape or form.

Justice chief may run for mayor of Iloilo City

JUSTICE Secretary Raul Gonzalez yesterday said like the other members of the Cabinet, he was considering running for an elective post in the 2010 elections, specifically as mayor of Iloilo City.

Gonzalez said his decision to seek elective office could be “best proof that there will be elections next year.” He added that Press Secretary Cerge Remonde was another Cabinet member who is considering joining the congressional race in Cebu.

“President Arroyo’s term will end in 2010 and I can’t expect the next administration to appoint me so I will probably just serve my people there in Iloilo,” he told reporters.

Gonzalez said he was also considering running for Congress, but only if his son, Raul Jr., the incumbent congressman, would yield to him.

“In my case, I can go back to law practice since I’ve been practicing law even before I was appointed Justice secretary or I could run. The best option for me is to run for mayor. I would like to spend my remaining time in my own home.”

Gonzalez served in government in various capacities—starting as a legal assistant to the governor of Iloilo in 1960 before serving as senior legal assistant to the mayor of Manila in 1961.

He was executive member of the Board of Censors for Motion Pictures under the Office of the President from 1963 to 1969, senior committee counsel to the committees on labor and immigration in the Philippine Senate, among others.

Gonzalez entered politics in 1995, running for and winning the lone congressional seat of Iloilo City. He was one of the public prosecutors during the impeachment trial of then President Joseph Ejercito Estrada.

In 2004, he served as co-chairman of the 14-member National Canvassing Board of the Philippine Congress. He was later appointed by President Arroyo as secretary of Justice.

Ombudsman orders probe vs ex-DBP chair, TRB exec

The Office of the Ombudsman's Field Investigation Office (FIO) has recommended graft investigations against two ranking officials of the Development Bank of the Philippines (DBP) and the Toll Regulatory Board (TRB).

Ordered probed were Vitaliano N. NaƱagas II, former DBP chairman and former President of the Philippine Deposit Insurance Company (PDIC), and Eunic Losantas, TRB's chief administrative officer.

Iin a 14-page complaint, the FIO said NaƱagas should be investigated for possible violation of the anti-graft law and for alleged swindling, which carries a maximum penalty of 20 years imprisonment.

The FIO ordered the probe based on NaƱagas's alleged "irregular reimbursements" of more than P300,000 for personal expenses, which he incurred during an official business to New York and Washington from May 15 to June 14 in 2001.

The FIO added that "NaƱagas made unnecessary and extravagant reimbursements" amounting to P66,374.28, for expenses by his unidentified representative in DBP meetings in the country.

"The reimbursements were made using receipts from restaurants incurred, the most, four times a day," the Ombudsman said in a statement.

The FIO, meanwhile, charged Losantas with perjury, violations of the Code of Conduct and Ethical Standards for Public Officials and Employees, Republic Act 1379 (Act Declaring Forfeiture of Ill-Gotten Wealth and Public Officer and Employees), Section 22 of the Omnibus Rules Implementing Book V of Executive Order 292 or Dishonesty, Grave Misconduct, Conduct Prejudicial to the Best Interest of the Service.

The FIO said Losantas was charged for failure to declare in his 2007 Statements of Assets, Liabilities and Net Worth her properties amounting to P18,936,047.07, which was too big an amount compared to the TRB official's annual income of P1,138,998.

Losantas's properties include a house and lot in Taytay, Rizal worth P1.5 million; a Mitsubishi Adventure worth P665,000; capital investment to Euniline Computer Services and Trading, a business registered under the name of his wife, amounting to P500,000; and cash worth P16,283,060.87, the FIO said.

Religion and politics according to Pope Benedict XVI

Before he became Pope Benedict XVI, Joseph Cardinal Ratzinger was head of the Congregation for the Doctrine of the Faith. In this role, he was in charge of defending the one true meaning of the Church’s doctrine against a range of other interpretations. On April 24, 2005, this chief “ideologue” of more than a billion Roman Catholics also became their leader.

It is important to point this out because Benedict XVI is probably the sharpest and most intellectually prepared of all those who had the rare opportunity to lead the world’s largest religion. Out of curiosity, I started to read the writings of this new Pope. I was amazed to discover how well he grasped the complexities of the modern world, and how concerned he was to define the Church’s role in the face of modernity. His reputation as a conservative precedes him, but this label does not at all do justice to the nuances of his thought. Benedict strikes me as a true modern — perhaps the first modern pope — one who understands and recognizes the growing differentiation and autonomy of the various spheres of human life.

A core issue that absorbed him was the relationship between politics and religion, state and church, and the pursuit of justice in relation to the service of love. His first encyclical letter, “Deus Caritas Est,” deals precisely with these questions. Lucid and deeply philosophical, this encyclical is perhaps the best available summing up of the Church’s understanding of its role in the modern world. This is of immense interest to me, not so much as a Catholic, but as a student of modernity. Here I present what I think constitutes the Church’s position on these issues — issues that are of great relevance to our present situation in the Philippines.

Benedict states the principle of church and state separation simply: “The state may not impose religion, yet it must guarantee religious freedom and harmony between the followers of different religions. For her part, the Church, as the social expression of Christian faith, has a proper independence and is structured, on the basis of her faith, as a community that the state must recognize. The two spheres are distinct, yet always interrelated.”

The separation of the two spheres is understood by most people; it is the interrelation, I think, that has caused confusion. Benedict’s position is finely nuanced, and strives for utmost clarity. “The just ordering of society and the state is a central responsibility of politics. As Augustine once said, a state that is not governed according to justice would be just a bunch of thieves.” How true!

“Justice is both the aim and the intrinsic criterion of all politics.” I think every democrat can easily agree with that. But Benedict goes further — he follows Kant and lays down the premises for the Church’s role in the pursuit of justice (which, he grants, is the principal function of politics). His argument is compelling. “Politics is more than a mere mechanism for defining the rules of public life: its origin and its goal are found in justice, which, by its very nature, has to do with ethics. The state must inevitably face the question of how justice can be achieved here and now. But … what is justice? The problem is one of practical reason; but if reason is to be exercised properly, it must undergo constant purification, since it can never be completely free of the danger of a certain ethical blindness caused by the dazzling effect of power and special interests. Here politics and faith meet.”

To Benedict, faith is a “purifying force for reason itself … faith liberates reason from its blind spots … faith enables reason to do its work more effectively and to see its proper object more clearly.” I love this formulation, but this is where theology and sociology part ways. The question is: Whose faith? Benedict anticipates this question, and offers a ready answer. Catholic social doctrine, he says, “has no intention of giving the Church power over the state. Even less is it an attempt to impose on those who do not share the faith ways of thinking and modes of conduct proper to faith. Its aim is simply to help purify reason and to contribute, here and now, to the acknowledgment and attainment of what is just.”

“To help purify reason” — what does it mean in politics? “The Church wishes to help form consciences in political life and to stimulate greater insight into the authentic requirements of justice, as well as greater readiness to act accordingly, even when this might involve conflict with one’s personal interest.” If this is not clear enough, Benedict makes it even clearer — I imagine — for people like the governor of Pampanga province, Fr. Eddie Panlilio, who prays for discernment about his future role in Philippine politics.

“The Church cannot and must not take upon herself the political battle to bring about the most just society possible. She cannot and must not replace the state. Yet at the same time she cannot and must not remain on the sidelines in the fight for justice. She has to play her part through rational argument and reawaken the spiritual energy without which justice, which always demands sacrifice, cannot prevail and prosper. A just society must be the achievement of politics, not the church. Yet the promotion of justice through efforts to bring about openness of mind and will to the demands of the common good concerns the Church deeply.”

Although you have not addressed your comments to me, I would like to share my 2 cents on the issue.

Timbangan and its hosts are one of the political machineries deployed by Gerry Espina Sr to dominate the airwaves to keep his political ambitions alive.

No amount of debate nor discussions on what is right is possible as the Timbangeros are directed to only do one thing: to destroy Rep Glenn Chong, his family and colleagues at all costs.

I have listened to almost all broadcasts of these people and like Utip in BI, they sing in unison to achieve the same objective: destroy Rep Glenn Chong at all cost and at every opportunity to create a better platform for a comeback for the members of the Espina Dynasty.

Until now, the Timbangeros have not answered my question about who are the main sponsors of their program. Where do they get their funds from? and what is the benefit their sponsors derived from this relentless and continuous attacks on Rep Glenn Chong and anyone they perceive to be a threat to the Espina Dynasty.

They do take on issues which seemingly create the impression that they are "fiscalizers", but in real terms, they twist issues to suit their arguments and take advantage of the Biliranons propensity for controversy.

It is untenable for Jerome Arcenal, George Manco and Jerry Tibon to play "holy art thou" when their pronouncements clearly reveal they are speaking in behalf of Gerry Espina Sr. As a matter of fact, Jerome took the place of Gerry Espina Sr in his absence on the March 26 broadcast.

They have lost the moral ascendancy to play fiscalizers because it is established that they are spokespersons of the Espina Dynasty.

Let us take for example the issue on the PCIJ report briefly mentioning GLENJOBEN Construction as owned by one of the Representatives who is a member of the committee tasked to review the WB-DPWH mess.

What PCIJ reported would like to highlight is, that the committee may have a conflict of interest on the issue as some of its members are engaged in construction business. There was no mention of GLENJOBEN being involved on the WB-DPWH issue being probed. The committee was tasked to probe the collusion of the named big construction companies involved in the projects which occurred between 2001 to 2006.

Rep Glenn Chong has declared in accordance with the law, his ownership of GLENJOBEN, being one of his previous occupations. There is nothing unethical, illegal nor immoral about that. PCIJ did not state GLENJOBEN was involved in collusion with DPWH on the World Bank funded projects that were the subject of the controversy.

The Timbangeros spin the issue around to make it look that GLENJOBEN is one of the companies being investigated for collusion with DPWH to support their arguments in radio and in the blog, that Rep Glenn Chong and DPWH Biliran are in collusion on projects being conducted in Biliran. As a matter of fact, there is no established case of collusion between DPWH and contractors in Biliran. This is a clear twist on the issue and obviously a big lie which only serves the interests of no other than Gerry Espina Sr.

Mr. Noel Pla is a collateral damage in the war declared by Gerry Espina Sr against Rep Glenn Chong, his family, colleagues and anyone who will be perceived to be a threat to the plan for the big comeback of the Espina Dynasty in 2010. He does not have to explain to the Timbangeros. Any issues he will discuss will be simply used against him. There are other ways to talk direct to the Biliranons; and one of the ways is for his accomplishments to speak for himself.

Remember, that Gerry Espina Sr has no respect for anyone that blocks his way. Not even the close relationship of Mr. Pla to Gerry Espina’s colleague, former Vice Mayor B Caneja.

Ironically, Gerry Espina Sr and Governor Roger Espina are on borrowed time. I am not saying they are already guilty of the offenses they have been accused of. Their luck may run out in the very near future, as political connections they have been relying on to delay if not eliminate the criminal case against Gerry Espina Sr and the violations against the anti graft law filed at the Office of the Ombudsman against Governor Espina, may no longer be there to shelter them.

That is why, 2010 is a do or die for the Espina Dynasty. Biliranons will expect soon a 24 hour barrage of negative issues against Rep Glenn Chong as Gerry Espina Sr gets more and more desperate.

I surely hope that Rep Glenn Chong will not play into Gerry Espina’s battle plan. I suggest that he changes his strategy to combat Gerry’s game plan. Surely, a pound for pound strategy, like what he is doing now, should be supported by more positive discussions on macro and micro issues that Biliranons can easily understand and benefit from. Negative issues will only give him a temporary edge; positive issues will have more impact in the long run.

I find it puzzling that the Timbangeros are making a big issue on the school bus system of Rep Glenn Chong. Is it not to Gerry Espina Sr's advantage if Rep Chong, thru his entrusted NGO, decides to replace his photos with commercial advertising? If not replacing all photos, but just adding some advertising spiels, will it diminish the impact of Rep Chong's photo on the buses for purposes of taking ownership of the project? Remember that banners are simply symbols of patronage politics. Please refer to my previous posts on the issue of billboards, banners and the like.

I think, the Timbangeros are not thinking straight. When Gerry Sr directs them to destroy Rep Chong, they don't have to follow it to the letter. They also must think, that maybe it is better to leave Rep Chong to his own devices and watch the public reaction?

But then again as a saying in business goes," when you pay peanuts you get monkeys” And that is exactly what the Timbangeros are, a very cheap political stunt. Gerry should know better, he is supposed to be an accomplished media man.

Rep Glenn Chong is simply fulfilling one of his election promises, to provide school buses to secondary students throughout Biliran to increase the participation rate of students from far flung barangays; who are most likely to leave school, due to the cost of transportation and the difficulties of having to walk to school and back. This is line with his agenda on education.

Sadly, the Espina Dynasty, in their 12 years of total control, had not thought about this. Now they find it strategically relevant to destroy the concept. Too late. It is working for Rep Chong.

I am more inclined to think that another bloodshed will not benefit either of the warring parties. Besides, Biliranons would have had enough of this, as it is not in our nature to be violent.

I do hope that the Church will not slow down in their advocacy for clean and honest elections; and in their support for any movement aimed towards promoting transparent, honest and accountable governance in Biliran.

Fathers, victims of genocidation

The whole world today celebrates FATHER’S DAY. The world dedicates a especial day to honor fathers as fathers are one of the most important influences in the lives of children, and their unconditional love is an indispensable anchor of certainty and strength.

However, as children in the world rejoice with their respective father, it is sad to contemplate that here in Biliran, 2 families have mourned because of the brutal killing of their father. Their lives had not been spared from any political problems that provide great havoc in our peaceful place. REGARDING THE PERSON OF STEPHEN GREINKE AND HIS MALICIOUS ACCUSATIONS AGAINST THE BISHOP OF NAVAL

We, the Clergy and faithful of the Diocese of Naval, would like to express our strongest condemnation to the lies peddled by Stephen Greinke against the bishop of Naval, the Most Rev. Filomeno G. Bactol, D.D.

Last January 2, 2008, Stephen Greinke, in a nationally televised network, has accused the bishop of sexually molesting young boys. We are aghast at this accusation because the bishop is a person of integrity whose ministry of 40 years (15 years in the seminary as formator, 7 years as Pastor, and 18 years as Bishop of Naval) has never been enmeshed in any controversy, much less scandal. We are appalled even more at the brazermess of Greinke as to impute upon the good name of the bishop the very same crime he was accused of doing against innocent young boys in the very Association he bas come to found, purportedly to proclaim the love of God only to find out it has become a trap for his sexual perversions! And that distinction between the Cebuano and Filipino is never more pronounced than the result of the 2001 Senatorial Elections.
